TERMS OF SERVICE

1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you and Harvester ("we," "us," or "our"), concerning your access to and use of the Harvester mobile application and any related services (collectively, the "Services").

You agree that by accessing the Services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Services and you must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms of Service.

2. AGE REQUIREMENTS

The Services are intended for users who are at least 17 years of age. By using the Services, you represent and warrant that you are at least 17 years old. If you are under 17 years of age, you are not permitted to use the Services.

3. USER REGISTRATION

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. USER CONTENT

The Services may invite you to chat, contribute to, or participate in forums, message boards, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or through the Services, including but not limited to text, writings, photographs, graphics, comments, and other material (collectively, "User Content").

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, distribute, modify, and display your User Content in connection with operating and providing the Services.

You represent and warrant that:

• You are the creator and owner of the User Content or have the necessary licenses, rights, consents, and permissions to use it
• Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity
• Your User Content is not false, inaccurate, or misleading
• Your User Content does not violate any applicable law, regulation, or rule

5. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Services, you agree not to:

• Systematically retrieve data or content to create a collection, compilation, database, or directory
• Trick, defraud, or mislead us or other users
• Circumvent, disable, or otherwise interfere with security-related features of the Services
• Disparage, tarnish, or otherwise harm us or the Services
• Use any information obtained from the Services to harass, abuse, or harm another person
• Make improper use of our support services or submit false reports of abuse or misconduct
• Use the Services in a manner inconsistent with any applicable laws or regulations
• Engage in unauthorized framing of or linking to the Services
• Upload or transmit viruses, Trojan horses, or other harmful material
• Engage in any automated use of the system, such as scripts or bots
• Interfere with, disrupt, or create an undue burden on the Services or connected networks
• Harass, annoy, intimidate, or threaten any of our employees, agents, or other users
• Post content that promotes illegal activities, including the illegal harvesting or poaching of wildlife
• Post graphic or gratuitous violent content
• Use the Services to advertise or offer to sell goods and services without our permission
• Impersonate another user or person

6. CONTENT MODERATION

We reserve the right, but not the obligation, to monitor, edit, or remove any User Content that we determine in our sole discretion violates these Terms, our Community Guidelines, or applicable law. We may also suspend or terminate your account for repeated violations.

7. DMCA / COPYRIGHT POLICY

We respect the intellectual property rights of others. If you believe that any content on the Services infringes your copyright, please contact us at support@harvesterpublic.com with the following information:

• A description of the copyrighted work that you claim has been infringed
• The URL or location of the infringing material
• Your contact information (name, address, telephone number, email)
• A statement that you have a good faith belief that the use is not authorized
• A statement that the information in the notification is accurate, under penalty of perjury
• Your physical or electronic signature

8. DATA DELETION

You may request deletion of your account and associated data at any time by contacting us at support@harvesterpublic.com. Upon receiving your request, we will delete your personal information from our active databases within 30 days. Some information may be retained in backups or as required by law.

9. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES.

Harvester does not provide hunting, fishing, or outdoor safety advice. Any content shared by users, including harvest locations, techniques, and regulations, is user-generated and may not be accurate. Always verify local hunting regulations and practice safe hunting habits.

10. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. GOVERNING LAW

These Terms shall be governed by and defined following the laws of the United States. Harvester and yourself irrevocably consent that the courts shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.
